STATE BOARD OF EDUCATION: ACTION
SUMMARY: This item presents for second reading and final adoption proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.47, Statistics, Adopted 2015 (One Credit). The proposal would add Texas Essential Knowledge and Skills (TEKS) for a new high school advanced mathematics course for implementation in the 2015-2016 school year. No changes are recommended since approved for first reading.
STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.
EFFECTIVE DATE: The proposed effective date of proposed new 19 TAC §111.47 is 20 days after filing as adopted with the Texas Register. Under TEC, §7.102(f), the State Board of Education (SBOE) must approve the rule action at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2015-2016 school year. The earlier effective date will enable districts to begin preparing for implementation of the new course.
PREVIOUS BOARD ACTION: In August 2013, the SBOE held a work session to discuss changes to the graduation requirements in order to align with the requirements of House Bill (HB) 5, 83rd Texas Legislature, Regular Session, 2013. At the January 2014 meeting, the SBOE approved the final adoption of new 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements. During the January 2014 meeting, the board also discussed future development of new courses. At the April 2014 meeting, the SBOE directed staff to move forward with the development of TEKS for two new mathematics courses, Algebraic Reasoning and Statistics.
A discussion item regarding the proposed new mathematics courses was presented to the Committee of the Full Board during the September 2014 meeting. At the November 2014 meeting, the SBOE approved for first reading and filing authorization new §111.47, Statistics, Adopted 2015 (One Credit).
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The 83rd Texas Legislature, 2013, passed HB 5, amending the TEC, §28.025, to change the high school graduation programs from the minimum, recommended, and advanced high school programs to one foundation high school program with endorsements to increase flexibility in graduation requirements for students. In August 2013, the SBOE held a work session to discuss changes to the graduation requirements in order to align with the requirements of HB 5, including discussion of courses required by HB 5. At the January 2014 meeting, the SBOE approved the final adoption of new 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements.
At that time, the SBOE discussed the need for additional rigorous mathematics course options for students. At the April 2014 meeting, the board directed staff to move forward with the development of two new mathematics courses, Algebraic Reasoning and Statistics.
A committee of mathematics educators was convened in Austin in June 2014 for a face-to-face meeting to begin working on recommendations for the Algebraic Reasoning and Statistics courses. The committee conducted four additional virtual meetings to complete their initial recommendations. The committee's recommendations were presented to the SBOE for review and comment at the September 2014 meeting. At that time, the board directed staff to provide to the committee written feedback that had been received related to the courses and to coordinate with the Texas Association of Supervisors of Mathematics to obtain additional feedback on the Algebraic Reasoning standards.
The committee held a subsequent meeting in October 2014 to work on additional revisions to both courses based on feedback they had received. The committee completed its work on the Statistics TEKS at that time, but determined that additional work was needed on the proposed TEKS for Algebraic Reasoning. At the November 2014 meeting, the board approved 19 TAC §111.47, Statistics, Adopted 2015 (One Credit), for first reading and filing authorization. The committee reconvened for an additional face-to-face and virtual meeting to finalize their recommendations for the Algebraic Reasoning course, which is presented to the SBOE for first reading and filing authorization as a separate item in this agenda.
Attachment II reflects the text of proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.47, Statistics, Adopted 2015 (One Credit), for consideration by the SBOE for second reading and final adoption. No changes are recommended since approved for first reading.
FISCAL IMPACT: There are fiscal implications for the Texas Education Agency (TEA) in fiscal year 2015 to reimburse committee members for travel to develop TEKS for the new courses. There are also implications for the TEA if the state develops professional development to help teachers and administrators understand the new courses. For fiscal year 2015, the estimated cost to the TEA for the development of the new Statistics course is $2,500.
There are anticipated fiscal implications for school districts and charter schools to implement the new courses, which may include the need for professional development and revisions to district-developed databases, curriculum, and scope and sequence documents. Since curriculum and instruction decisions are made at the local district level, it is difficult to estimate the fiscal impact on any given district.
The TEA has determined that there is no direct adverse economic impact for small businesses or microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.
PUBLIC AND STUDENT BENEFIT: Benefits include added flexibility in course options for students to meet new high school graduation requirements.
PROCEDURAL AND REPORTING IMPLICATIONS: The proposed new rule would have no new procedural and reporting requirements.
LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed new rule would have no new locally maintained paperwork requirements.
PUBLIC COMMENTS: Following the November 2014 SBOE meeting, notice of proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.47, Statistics, Adopted 2015 (One Credit), was filed with the Texas Register, initiating the official public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received regarding the proposal will be provided to the SBOE prior to and during the February 2015 meeting.

MOTION TO BE CONSIDERED: The State Board of Education:
By an affirmative vote of two-thirds of the members of the board, approve for second reading and final adoption proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.47, Statistics, Adopted 2015 (One Credit), with an effective date of 20 days after filing as adopted with the Texas Register.
