1. Adoption of Review of 19 TAC Chapter 101, Assessment
(Adoption of Review)
Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the adoption of the review of 19 TAC Chapter 101, Assessment, Subchapter A, General Provisions, Subchapter B, Implementation of Assessments, and Subchapter C, Local Option. The rules being reviewed address the development and administration of tests, voluntary assessment of private school students, the schedule for the release of tests, and administration and reporting of group-administered achievement tests. The statutory authority for the rule review is Texas Government Code, §2001.039. The statutory authority for 19 TAC Chapter 101, Subchapters A-C, is Texas Education Code (TEC), §§39.021-39.023, 39.025, 39.032, and 39.033.

This item presents for second reading and final adoption proposed new 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other than English, Subchapter C, High School, §114.53, Advanced Language for Career Applications (One Credit). The proposed new rule would implement House Bill (HB) 1431, 84th Texas Legislature, 2015, which requires the State Board of Education (SBOE) to develop an advanced languages other than English (LOTE) course that prepares students to communicate in a language other than English in a specific professional, business, or industry environment. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(4) and §28.002(t).

3. Proposed Repeal of 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other Than English, Subchapter A, Elementary, §114.1 and §114.2, Subchapter B, Middle School, §114.11 and §114.12, and Subchapter C, High School, §§114.21-114.29
(First Reading and Filing Authorization)
This item presents for first reading and filing authorization proposed repeal of 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other than English, Subchapter A, Elementary, §114.1 and §114.2, Subchapter B, Middle School, §114.11 and §114.12, and Subchapter C, High School, §§114.21-114.29. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS) adopted to be effective in 1998 for elementary, middle, and high school languages other than English (LOTE) and related implementation language, that will be superseded by new 19 TAC §§114.3, 114.4, 114.13, 114.14, and 114.31-114.52 beginning with the 2017-2018 school year. This item presents for second reading and final adoption proposed amendments to 19 TAC Chapter 115, Texas Essential Knowledge and Skills for Health Education, Subchapter B, Middle School, and Subchapter C, High School. The proposed amendments would add student expectations for prescription drug awareness to the health education Texas Essential Knowledge and Skills (TEKS) in accordance with Senate Bill (SB) 968, 84th Texas Legislature, 2015. No additional changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(4) and §28.002(c) and (w).

5. Proposed Approval of Innovative Courses
This item recommends approval of innovative courses that do not fall within any of the subject areas of the foundation or enrichment curriculum. Statutory authority for this action is the Texas Education Code (TEC), §28.002(f).

6. Consideration of Penalties Related to Instructional Materials Contracts
This item provides an opportunity for the State Board of Education (SBOE) to consider imposing a penalty on a publisher of instructional materials for failure to provide the materials to districts as required by its contract. Statutory authority for this action is the Texas Education Code (TEC), §31.151.
