Proposed Revisions to State Board of Education Operating Rules Sections 1.2 and 2.5

STATE BOARD OF EDUCATION: ACTION
SUMMARY: The State Board of Education will consider revising Operating Rules §1.2, Committees of the Board and §2.5, Agendas to clarify how items may be placed on committee and board agendas.
STATUTORY AUTHORITY: Texas Education Code (TEC), §7.107.
PREVIOUS BOARD ACTION: The State Board of Education revised and approved its operating rules on February 11, 2015.
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The board is required by state law to adopt rules of procedures at its first regular meeting after the election and the qualifications of new members. The board did approve revised rules on February 11, 2015. A board member requested that the board reconsider §1.2 and §2.5 in order to correctly place agenda-related sections in the agenda chapter of the operating rules and to clarify how an item is placed on the agenda.
FISCAL IMPACT: None.
PUBLIC AND STUDENT BENEFIT: The board will operate efficiently with clear operating rules.
PROCEDURAL AND REPORTING IMPLICATIONS: In preparing the April agenda, it has become clear that different board members and staff members interpret the current §1.2(c) of the operating rules differently. Adopting concise language that clarifies who may place an item on the agenda and determines whether it is to be a discussion or action item will allow staff to efficiently prepare an accurate agenda for the board.
