STATE BOARD OF EDUCATION: CONSENT

SUMMARY:
This item presents for first reading and filing authorization proposed amendment to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.43, Mathematical Models with Applications, Adopted 2012 (One-Half to One Credit). The proposal would modify the amount of credit that could be earned for the course and eliminate language requiring a course sequence, which is inconsistent with graduation requirements.

STATUTORY AUTHORITY:
Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

EFFECTIVE DATE:
The proposed effective date of proposed amendment to 19 TAC §111.43 is August 24, 2015.

PREVIOUS BOARD ACTION:
The State Board of Education (SBOE) adopted the Texas Essential Knowledge and Skills (TEKS) for Algebra I, Algebra II, and Geometry effective September 1, 1996, and adopted the TEKS for elementary, middle school, Precalculus, Mathematical Models with Applications, and other high school mathematics courses effective September 1, 1998. The mathematics TEKS in 19 TAC Chapter 111, Subchapters A-C, were amended effective August 1, 2006 and February 22, 2009. The mathematics TEKS in 19 TAC Chapter 111, Subchapter D, were amended effective October 21, 2007, July 12, 2010, and September 10, 2012.

The SBOE adopted the TEKS for Advanced Quantitative Reasoning effective August 22, 2011. Revisions to the elementary, middle school, and high school mathematics TEKS were adopted by the SBOE effective September 10, 2012, and the mathematics TEKS adopted effective 1998 for elementary and middle school were repealed effective December 2014. The revised mathematics TEKS for elementary and middle school were implemented in the 2014-2015 school year. The revised mathematics TEKS for high school are scheduled for implementation in the 2015-2016 school year. The SBOE adopted the TEKS for Discrete Mathematics for Problem Solving effective August 25, 2014.

In February 2015, the board adopted new TEKS for an advanced high school mathematics course, Statistics. The board also approved for first reading and filing authorization proposed TEKS for a second advanced high school mathematics course, Algebraic Reasoning.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: SBOE rules in 19 TAC Chapter 74, Subchapters F and G, for the Recommended High School Program allow Mathematical Models with Applications to satisfy one of the four required credits in mathematics provided that the course is successfully completed prior to Algebra II. Revisions to the TEKS for Mathematical Models with Applications were last adopted by the SBOE in 2012. At that time, language was included in the TEKS for Mathematical Models with Applications to specify that the course must be completed prior to Algebra II in order to align with the graduation requirements in place at that time. With the implementation of the Foundation High School Program, however, the SBOE has eliminated language in 19 TAC Chapter 74, Subchapter B, requiring a specific course sequence for mathematics. This item would eliminate the language in the TEKS for Mathematical Models with Applications that requires that the course be taken before being given credit for Algebra II. This item would also change the credit awarded for the course to one credit in order to align with changes to credit in other content areas.

Attachment II reflects the text of the proposed amendment to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.43, Mathematical Models with Applications, Adopted 2012 (One-Half to One Credit), for consideration by the SBOE for first reading and filing authorization. The proposed amendment includes a change to the section title to reflect the amount of credit to be awarded for successful completion of the course.

FISCAL IMPACT:
The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed rule action. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT:
Benefits include added flexibility in course sequencing for students to meet high school graduation requirements.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed amendment would have no new procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS:
The proposed amendment would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS:
The official public comment period will begin when the proposal is published in the Texas Register.

ALTERNATIVES:
None.

OTHER COMMENTS AND RELATED ISSUES: A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

Proposed new 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.48, Algebraic Reasoning, Adopted 2015 (One Credit), is presented for second reading and final adoption as a separate item in this agenda.

MOTION TO BE CONSIDERED: The State Board of Education:

Approve for first reading and filing authorization proposed amendment to 19 TAC Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter C, High School, §111.43, Mathematical Models with Applications, Adopted 2012 (One-Half to One Credit).
