Approval for New Bids for Products Adopted under Proclamation 2015

SUMMARY:
The deadline for submission of official bids on products adopted under Proclamation 2015 was September 26, 2014. Several publishers have requested approval to change or add to the bids they submitted at that time. This item provides an opportunity for the State Board of Education (SBOE) to approve the inclusion of these new or replacement bids in the educational materials (EMAT) system for districts to choose from in ordering Proclamation 2015 materials.

STATUTORY AUTHORITY: Texas Education Code (TEC), §31.026 and §31.151.

PREVIOUS BOARD ACTION: Proclamation 2015 was issued by the SBOE in April 2013. Instructional materials were adopted in November 2014 under Proclamation 2015.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES:  The deadline approved by the SBOE for publishers to file official bids was Friday, September 26, 2014. Following that submission deadline, the Texas Education Agency received several inquiries from publishers regarding the possibility of submitting additional or replacement bids for materials adopted under Proclamation 2015.

Under TEC, §31.026, the SBOE must execute a contract for the purchase or licensing of each adopted instructional material. This contract must provide for the purchase or licensing of instructional material at a specific price, which may not exceed the lowest price paid by any other state or any school or school district. The price must be fixed for the term of the contract. By allowing publishers to add new or replacement bids, school districts will have access to more competitively-priced instructional materials.

FISCAL IMPACT: It is anticipated that inclusion of new or replacement bids will result in access for school districts and charter schools to more competitively-priced instructional materials related to Proclamation 2015.

PUBLIC AND STUDENT BENEFIT: Students will have access to new instructional materials aligned to revised Texas Essential Knowledge and Skills for use beginning in the 2015-2016 school year.

PROCEDURAL AND REPORTING IMPLICATIONS: Adopted materials will be included in the EMAT online system.

MOTION TO BE CONSIDERED: The State Board of Education:

Include new or replacement bids that were submitted to TEA by 5:00 p.m. CST on Friday, January 23, 2015 in the educational materials (EMAT) system for districts to choose from in ordering Proclamation 2015 materials.
