SUMMARY: This item presents for first reading and filing authorization proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Relating to New Marketing and Second-level Practicum Courses. The proposal would add new Texas Essential Knowledge and Skills (TEKS) for a number of new career and technical education (CTE) practicum courses and a new CTE Advanced Marketing course. The proposal would add new level II practicum courses in 19 TAC §§130.32, 130.68, 130.69, 130.70, 130.71, 130.72, 130.117, 130.118, 130.119, 130.120, 130.121, 130.122, 130.144, 130.166, 130.211, 130.234, 130.262, 130.263, 130.285, 130.313, 130.314, 130.343, 130.367, 130.388, 130.419, 130.465, 130.466 and a new Advanced Marketing course in 19 TAC §130.389. The proposal recommends an implementation date of the 2017-2018 school year.
STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.00222, and 28.025.
EFFECTIVE DATE: The proposed effective date of proposed new 19 TAC Chapter 130, §§130.32, 130.68-130.72, 130.117-130.122, 130.144, 130.166, 130.211, 130.234, 130.262, 130.263, 130.285, 130.313, 130.314, 130.343, 130.367, 130.388, 130.389, 130.419, 130.465, and 130.466, is August 28, 2017.
PREVIOUS BOARD ACTION: The State Board of Education (SBOE) initially adopted the TEKS for CTE courses effective September 1, 1998. The CTE TEKS were revised by the SBOE in July 2009 effective August 23, 2010. In April 2014, the board approved revisions to the process for review and revision of the TEKS to include more specific direction to TEKS review committees. The revised process is being used for the current review and revision of the CTE TEKS.
At the February 2015 SBOE meeting, the board approved for first reading and filing authorization proposed new 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development, Subchapter A, Middle School, and Subchapter B, High School, and proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, Subchapter D, Business Management and Administration, Subchapter E, Education and Training, Subchapter F, Finance, Subchapter I, Hospitality and Tourism, Subchapter J, Human Services, Subchapter M, Manufacturing, and Subchapter N, Marketing. The SBOE postponed first reading and filing authorization of proposed new 19 TAC §130.183, Financial Mathematics (One Credit), Adopted 2015, until the April 2015 meeting.
The SBOE approved for second reading and final adoption proposed new 19 TAC Chapter 127, Subchapters A and B, and Chapter 130, Subchapters C, D, E, F, I, J, M, and N, at the April 2015 meeting. At that time, the SBOE postponed final action on §130.256, Food Chemistry (One Credit), Adopted 2015, §130.362, Introduction to Welding (One Credit), Adopted 2015, §130.363, Welding I (Two Credits), Adopted 2015, §130.364, Welding II (Two Credits), Adopted 2015, §130.365, Welding II Lab (One Credit), Adopted 2015, and §130.387, Practicum in Marketing I (Two to Three Credits), Adopted 2015, until the July 2015 meeting. Also at the April 2015 SBOE meeting, the board approved for first reading and filing authorization proposed new 19 TAC Chapter 130, Subchapters A, B, G, H, K, L, O, and P, and §130.183, Financial Mathematics (One Credit), Adopted 2015.
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: Applications for appointment to CTE TEKS review committees were accepted by the Texas Education Agency (TEA) from October 2013 through January 10, 2014. Nominations for CTE TEKS review committees were made in spring 2014 and committee members were notified of the appointment in May 2014. The CTE TEKS review committees convened in Austin in June 2014 to begin work on draft recommendations for the TEKS. The committees met again in July 2014 to complete their initial draft recommendations. Mathematics and science educators were also in attendance at the July meeting to provide content expertise to the CTE TEKS review committees in the revision and development of TEKS for courses that may satisfy a mathematics or science credit. In September 2014 the first draft recommendations were posted to the TEA website for informal feedback, and the TEA shared the draft recommendations with numerous stakeholders, including professional organizations and educators. At the September 2014 SBOE meeting, one representative from each CTE TEKS review committee provided invited testimony to the Committee on Instruction. In October 2014, the CTE TEKS review committees met for a third time in order to continue work to finalize their recommendations for revisions to the CTE TEKS.
Due to the number of CTE courses included in the CTE TEKS review, the SBOE has divided the adoption of the CTE TEKS revisions into two portions. The final recommendations from the CTE TEKS review committees for 19 TAC Chapter 127, Texas Essential Knowledge and Skills for Career Development, Subchapter A, Middle School, and Subchapter B, High School, and 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, Subchapter D, Business Management and Administration, Subchapter E, Education and Training, Subchapter F, Finance, Subchapter I, Hospitality and Tourism, Subchapter J, Human Services, Subchapter M, Manufacturing, and Subchapter N, Marketing, were posted on the TEA website in November 2014 and were shared with SBOE members as a discussion item at the November 2014 meeting. A public hearing on the proposed new 19 TAC Chapter 127, Subchapters A and B, and Chapter 130, Subchapters C, D, E, F, I, J, M, and N, was held in February 2015 and the SBOE approved the proposal for first reading and filing authorization. At that time, the board postponed action on proposed new §130.183, Financial Mathematics (One Credit), Adopted 2015, until its April 2015 meeting to allow additional time to review recommendations.
At the April 2015 SBOE meeting, a public hearing on the proposed new CTE TEKS was held. At the meeting the board approved for second reading and final adoption the first portion of the proposed new CTE TEKS, proposed new 19 TAC Chapter 127, Subchapters A and B, and Chapter 130, Subchapters C, D, E, F, I, J, M, and N. The board postponed until the July 2015 meeting final action for six CTE courses, §130.256, Food Chemistry (One Credit), Adopted 2015, §130.362, Introduction to Welding (One Credit), Adopted 2015, §130.363, Welding I (Two Credits), Adopted 2015, §130.364, Welding II (Two Credits), Adopted 2015, §130.365, Welding II Lab (One Credit), Adopted 2015, and §130.387, Practicum in Marketing I (Two to Three Credits), Adopted 2015, to allow additional time to review recommendations.
The final recommendations from the CTE TEKS review committees for the second portion of the CTE TEKS, those included in 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter A, Agriculture, Food, and Natural Resources, Subchapter B, Architecture and Construction, Subchapter G, Government and Public Administration, Subchapter H, Health Science, Subchapter K, Information Technology, Subchapter L, Law, Public Safety, Corrections, and Security, Subchapter O, Science, Technology, Engineering, and Mathematics, and Subchapter P, Transportation, Distribution, and Logistics, were posted to the TEA website in December 2014 and were provided to the board as a discussion item at the February 2015 SBOE meeting. At that time, the SBOE directed staff to make technical edits to these courses to align with amendments made to the TEKS for 19 TAC Chapter 127, Subchapters A and B, and Chapter 130, Subchapters C, D, E, F, I, J, M, and N. The board approved for first reading and filing authorization proposed new 19 TAC Chapter 130, Subchapters A, B, G, H, K, L, O, and P, and §130.183, Financial Mathematics (One Credit), Adopted 2015, the second portion of CTE TEK courses, at the April 2015 meeting. The SBOE directed staff to make any technical edits to these courses to align with amendments made at the April 2015 meeting to the proposed CTE TEKS in 19 TAC Chapter 127, Subchapters A and B, and Chapter 130, Subchapters C, D, E, F, I, J, M, and N. The SBOE also directed TEA staff to prepare a new second-level practicum course for each proposed practicum and a new Marketing Dynamics course for consideration at a future meeting.
Subsequent to the April 2015 SBOE meeting, the original section number for the proposed new Financial Mathematics TEKS was changed to §130.180. This was necessary to ensure the Financial Mathematics TEKS take effect August 24, 2015, the beginning of the 2015-2016 school year. The section number originally proposed is currently assigned and will not be repealed and available for use as a section number until August 2017.
The text of proposed new 19 TAC Chapter 130, §§130.32, 130.68-130.72, 130.117-130.122, 130.144, 130.166, 130.211, 130.234, 130.262, 130.263, 130.285, 130.313, 130.314, 130.343, 130.367, 130.388, 130.389, 130.419, 130.465, and 130.466, will be provided as a separate exhibit for consideration by the SBOE for first reading and filing authorization.
FISCAL IMPACT: There may be fiscal implications for the TEA to create professional development to help teachers and administrators understand the revisions to the TEKS. For fiscal years 2014 and 2015, the estimated cost to the TEA for reviewing and revising this set of TEKS was accounted for as part of the initial review and revision of all of the CTE TEKS and there is no additional fiscal impact for revision of this set of courses.
There are anticipated fiscal implications for school districts and charter schools to implement the revised TEKS, which may include the need for professional development and revisions to district-developed databases, curriculum, and scope and sequence documents. Since curriculum and instruction decisions are made at the local district level, it is difficult to estimate the fiscal impact on any given district.
The TEA has determined that there is no direct adverse economic impact for small businesses or microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.
PUBLIC AND STUDENT BENEFIT: Benefits include better alignment of the TEKS and coordination of the standards with the adoption of instructional materials.
PROCEDURAL AND REPORTING IMPLICATIONS: The proposed rule actions would have no procedural and reporting requirements.
LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed rule actions would have no new locally maintained paperwork requirements.
PUBLIC COMMENTS: The official public comment period will begin when the proposal is published in the Texas Register.
