SUMMARY: This item presents for second reading and final adoption a proposed amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, §130.121, Extended Practicum in Fashion Design (Two to Three Credits), Adopted 2015. The proposed amendment would change the amount of credit offered for the course to be consistent with other extended practicum courses. No changes are recommended since approved for first reading.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102, 28.002, and 28.025, as amended by House Bill (HB) 3593 and Senate Bill (SB) 826, 85th Texas Legislature, Regular Session, 2017.

TEC, §7.102(c)(4), requires the State Board of Education (SBOE) to establish curriculum and graduation requirements.

TEC, §28.002, identifies the subjects of the required curriculum and requires the SBOE by rule to identify the essential knowledge and skills of each subject in the required curriculum that all students should be able to demonstrate and that will be used in evaluating instructional materials and addressed on the state assessment instruments.

TEC, §28.025, as amended by HB 3593 and SB 826, 85th Texas Legislature, Regular Session, 2017, requires the SBOE by rule to determine the curriculum requirements for the foundation high school graduation program that are consistent with the required curriculum under the TEC, §28.002.

EFFECTIVE DATE: The proposed effective date of the proposed amendment is 20 days after filing as adopted with the Texas Register. Under TEC, §7.102(f), the SBOE must approve the rule action at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2018-2019 school year. The earlier effective date is necessary to align the amount of credit available for Extended Practicum in Fashion Design with all extended practicum courses in order to avoid confusion during the 2017-2018 school year.

PREVIOUS BOARD ACTION: The SBOE adopted the Texas Essential Knowledge and Skills (TEKS) for career and technical education (CTE), including career development, effective September 1, 1998. The CTE TEKS were amended effective August 23, 2010. In April 2015 and July 2015, the board approved for second reading and final adoption proposed revisions to the CTE TEKS. At the September 2015 meeting, the board approved for second reading and final adoption proposed new CTE TEKS for an Advanced Marketing course and second-level practicum and automotive technology courses. The revised CTE TEKS were implemented at the start of the 2017-2018 school year.

The SBOE approved the proposed amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, §130.121, Extended Practicum in Fashion Design (Two to Three Credits), Adopted 2015, for first reading and filing authorization at the September 2017 meeting.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: In 2015, the SBOE adopted new CTE TEKS, which were implemented beginning with the 2017-2018 school year. The new TEKS eliminated the range of credit for CTE courses and implemented a consistent amount of credit for each course. Additionally, the new TEKS provide a number of one-credit extended practicum courses. During a review of the new CTE TEKS, staff discovered an error in the amount of credit identified for the Extended Practicum in Fashion Design course. As adopted, the course includes a range of two to three credits, which is not consistent with all other extended practicum courses.

Attachment II reflects the text of proposed amendment to 19 TAC §130.121, which would amend the amount of credit available for the course to one credit to be consistent with other extended practicum courses.

No changes are recommended since approved for first reading.

FISCAL IMPACT: The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed amendment. In addition, there is no direct adverse economic impact for small businesses, microbusinesses, and rural communities; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required. There is no effect on local economy for the first five years the proposed amendment is in effect; therefore, no local employment impact statement is required under Texas Government Code, §2001.022. The proposed amendment does not impose a cost on regulated persons and, therefore, is not subject to Texas Government Code, §2001.0045.

PUBLIC AND STUDENT BENEFIT: Benefits include consistent amount of credit for all extended practicum courses.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed amendment would have no procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed amendment would have no locally maintained paperwork requirements.

PUBLIC COMMENTS: Following the September 2017 SBOE meeting, notice of the proposed amendment to 19 TAC §130.121 was filed with the Texas Register, initiating the public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received regarding the proposal will be provided to the SBOE during the November 2017 meeting.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: Proposed revisions to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapters B, H, J, M, and O, are presented for first reading and filing authorization as a separate item in this agenda.

By an affirmative vote of two-thirds of the members of the board, approve for second reading and final adoption the proposed amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, §130.121, Extended Practicum in Fashion Design (Two to Three Credits), Adopted 2015, with an effective date of 20 days after filing as adopted with the Texas Register.
