Discussion of Proposed Amendments to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter A, Gifted/Talented Education

COMMITTEE ON INSTRUCTION: DISCUSSION
STATE BOARD OF EDUCATION: NO ACTION
SUMMARY: This item provides an opportunity for the committee to discuss proposed amendments to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter A, Gifted/Talented Education, to consider changes recommended during the four-year rule review for Chapter 89.
STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(15), 29.123, and 42.156.
TEC, §7.102(c)(15), requires the State Board of Education (SBOE) to adopt criteria for identifying gifted and talented students and develop and update a state plan for the education of gifted and talented students.
TEC, §29.123, requires the SBOE to develop and periodically update a state plan for the education of gifted and talented students to guide school districts in establishing and improving programs for identified students.
TEC, §42.156, requires each school district to account for the expenditure of state funds as provided by rule of the SBOE.
BOARD RESPONSE: This item is presented for review and comment.
PREVIOUS BOARD ACTION: The SBOE adopted 19 TAC Chapter 89, Subchapter A, effective September 1996. The SBOE first approved The Texas State Plan for the Education of Gifted/Talented Students (State Plan) in November 1996. The SBOE approved updates to the State Plan in July 2009.
FUTURE ACTION EXPECTED: At the direction of the committee, first reading and filing authorization of proposed amendments to 19 TAC Chapter 89, Subchapter A, will be presented at a future meeting.
BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The rules in 19 TAC Chapter 89, Subchapter A, provide for assessment and services for students; professional development for teachers, counselors, and administrators; and program accountability. The rules have been used as the foundation of the State Plan since November 1996.
FISCAL IMPACT: None.
PUBLIC AND STUDENT BENEFIT : Districts and schools will have accurate and appropriate information and resources for providing services to students identified as gifted/talented.
PROCEDURAL AND REPORTING IMPLICATIONS: Procedural and reporting implications will be assessed after the committee gives direction regarding a proposal to bring forward for first reading and filing authorization.
LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: Locally maintained paperwork requirements will be assessed after the committee gives direction regarding a proposal to bring forward for first reading and filing authorization.
PUBLIC COMMENTS: The official public comment period will begin when a proposal, approved for first reading and filing authorization by the SBOE, is published in the Texas Register.
